Access to talkia.it and to the Talkia platform requires full acceptance of these Terms. Talkia is an Aydia product by Areaweb Srl.
Registration and account
Access to the Talkia platform is limited to accounts activated by Areaweb. On activation the User provides truthful, current and complete information, and is responsible for its accuracy.
The User promptly reports any change to that information, in particular to the email address linked to the account, which is the channel used for service communications.
Credential security
The User is the sole keeper of their access credentials and is accountable for them. Sharing them with unauthorised third parties is prohibited.
Any activity carried out through the User's account is treated as carried out by the User directly. If unauthorised use is suspected, the User notifies Areaweb without delay.
Licence and intellectual property
Areaweb grants the User a limited, personal, non-exclusive and non-transferable licence to access and use the platform in accordance with these Terms and with the agreement signed between the parties.
The software, the interface, the documentation, the Talkia and Aydia trade marks and all platform content remain the property of Areaweb Srl. The licence transfers no intellectual property rights.
User content and knowledge base
The documents, text and content the User uploads to the knowledge base, along with data made available through configured integrations, remain the property of the User.
The User warrants that they hold the rights to use that content and undertakes not to upload unlawful material or material infringing the rights of others. Areaweb processes it solely in order to provide the service.
Chatbot answers are generated from the content supplied by the User and from the configured engine. The User is responsible for the completeness and currency of the sources they provide.
Prohibited activities and acceptable use
The platform must not be used to upload or distribute unlawful content, introduce malware, run unauthorised penetration tests or vulnerability scans, attempt to reach other users' areas or data, or resell the service without Areaweb's written consent.
The chatbot must also not be used to mislead end visitors, including presenting it as a human being where doing so is liable to deceive.
Service availability and updates
Areaweb works to keep the platform accessible but does not guarantee uninterrupted operation: scheduled maintenance, technical work or causes outside Areaweb's control may lead to temporary suspensions.
The platform is subject to updates and functional change. Available features depend on the modules enabled, the engine selected and the integrations configured; some features are described on this site as in development and cannot be enabled until release.
Delivery may depend on third-party services, including language model providers. Unavailability of those services may affect how the chatbot behaves.
Fees
Fees, term and payment arrangements are those set out in the offer or contract signed between the parties. This site publishes no price list and accounts are activated by invitation.
Unless agreed otherwise in writing, amounts are exclusive of VAT and of any other applicable tax.
Cancellation and suspension
The User may request termination of the service as provided for in the agreement they signed.
Areaweb may suspend or deactivate an account in the event of a breach of these Terms, of use that compromises the security or stability of the platform, or of non-payment, with no refund due for the remaining period.
Limitation of liability
To the extent permitted by law, Areaweb is not liable for any damage, financial or non-financial, direct or indirect, arising from use or inability to use the platform, including loss of data, loss of profit or business interruption.
In particular, Areaweb is not liable for the content of answers generated by the chatbot from the sources and configuration prepared by the User, nor for decisions taken by the User or their customers in reliance on them.
Areaweb remains liable in cases of wilful misconduct or gross negligence, and mandatory consumer rights are unaffected.
Privacy and cookies
Personal data is processed in accordance with Regulation (EU) 2016/679 (GDPR) and applicable Italian law, as described in the privacy policy and cookie policy published on this site.
In delivering the service, Areaweb processes on the User's behalf the data contained in conversations with visitors to the User's website, on the terms set out in the agreements signed between the parties.
Third-party links and services
The platform can integrate with third-party services, including e-commerce platforms, language model providers and automation tools. Areaweb accepts no responsibility for the availability, security, contractual terms or content of those services.
Use of a third-party service remains governed by that provider's own terms.
Changes to these Terms
Areaweb may update these Terms for regulatory, technical or organisational reasons. The version published on this page, with its update date, is the one in force.
Material changes are communicated to active Users with reasonable notice.
Governing law and jurisdiction
These Terms are governed by Italian law.
The courts of Brescia have exclusive jurisdiction over any dispute, without prejudice to mandatory consumer protection provisions, which point to the courts of the consumer's place of residence or elected domicile.
